Rand Paul Files Measure to End Birthright Citizenship

(MENAFN) Republican Senator Rand Paul escalated the battle over US immigration policy on Monday, announcing he had formally introduced a constitutional amendment that would strip automatic citizenship rights from children born on American soil to undocumented immigrants.

The Kentucky lawmaker made the announcement on X, the US social media platform owned by Elon Musk.

"I introduced a constitutional amendment to end birthright citizenship," Paul said on X.

He followed the declaration with a pointed challenge to the legal foundation long cited by birthright citizenship defenders.

"The 14th Amendment was never meant to reward illegal entry," he said.

Paul drew a sharp distinction between legal and illegal immigration, casting the former as a cornerstone of American prosperity and the latter as a mechanism being exploited to secure citizenship benefits.

"Legal immigration built this country. Illegal immigration is being used to game the system. Only children of legal residents should receive automatic citizenship," Paul said.

The move aligns with a broader push by President Donald Trump, who signed an executive order shortly after taking office last year seeking to dismantle the longstanding policy of granting citizenship to any individual born on US territory whose mother was undocumented. That order was swiftly met with legal challenges from civil rights organisations and multiple US states.

At the heart of the dispute is the 14th Amendment to the US Constitution, ratified in 1868 in the aftermath of the Civil War. The amendment explicitly grants citizenship to all persons born or naturalised in the United States and subject to its jurisdiction — a clause that has for over a century served as the legal bedrock of birthright citizenship.
